Participation Waiver & Assumption of Risk
Please read carefully before participating.
I understand that participation in an Ask The Health Coach community workout is voluntary and involves physical activity, including activities that may involve strength training, cardiovascular exercise, mobility, balance, body-weight movements, and other forms of exercise.
I understand that physical activity involves inherent risks. These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, dizziness, shortness of breath, abnormal blood pressure or heart rate responses, injury, aggravation of a pre-existing condition, and, in rare circumstances, serious medical events.
I understand that I am responsible for monitoring how I feel during the workout and for exercising within my personal abilities. I agree to stop exercising and notify Carlos Duncan if I experience pain, dizziness, unusual shortness of breath, chest discomfort, loss of balance, or any other symptom that concerns me.
I understand that Carlos Duncan and Ask The Health Coach do not diagnose medical conditions or provide medical treatment. If I have a medical condition, injury, symptoms, or have been advised by a healthcare professional to restrict physical activity, I understand that it is my responsibility to obtain appropriate medical guidance before participating.
By participating, I voluntarily accept and assume the risks associated with physical exercise and participation in this community workout.
RELEASE OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I VOLUNTARILY RELEASE AND AGREE TO HOLD HARMLESS ASK THE HEALTH COACH, CARLOS DUNCAN, AND THEIR REPRESENTATIVES FROM CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE COMMUNITY WORKOUT, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LEGALLY BE WAIVED OR RELEASED.
I understand that by agreeing to this waiver, I may be giving up certain legal rights. I have had the opportunity to read this agreement before participating and voluntarily agree to its terms.
I intentionally made that section conspicuous because release provisions deserve special attention; don't shrink it into fine print. The Texas statutes also distinguish ordinary negligence from gross negligence/willful conduct in several liability contexts, which is another reason I would not write this as an unlimited "you can never sue us for anything" release.
Emergency Assistance
I would make this a separate section immediately after the waiver:
Emergency Assistance Authorization
If I become injured, ill, or experience a medical emergency during the community workout, I authorize Carlos Duncan and/or Ask The Health Coach representatives to contact 911 or other emergency medical services when reasonably believed necessary.
I understand that Carlos Duncan and Ask The Health Coach are not medical providers and that any assistance provided is intended only to obtain or provide appropriate emergency assistance within the responder's level of training.
I understand that I am responsible for any costs associated with emergency medical evaluation, transportation, or treatment provided to me.
